Rule 32
The government of Nepal can declare any industry under the conditions mentioned in sub-section (1) of section 39 of the
Act as a sick industry based on the following criteria:-
(a) Operating at a continuous loss for three years: the capital (equity) of the industry has decreased by more than thirty percent,
(b) / Failure to pay the principal interest of the loan in accordance with the loan agreement,
(c) In proportion to capital, the amount of debt is greater,
(d) In the case of industries listed in the Nepal Securities Board, the market price is less than the market price,
(e) For any other reason, the condition of sub-section (1) of section 39 of the Act.
